BLACKFOOT â€” Erik Matthew Nava, age 27, was sentenced Wednesday to 12 years in the Idaho State Penitentiary by Seventh District Judge Darren Simpson. Nava's sentence is for not less than five years and not more than 12 years in the state penitentiary. He can seek help in the penitentiary if he asks for it.
Nava was also fined $1,000. He was given credit for 81 days served in the Bingham County Jail.
The felony charge of attempted strangulation against Nava was because Nava choked/ strangled his girlfriend for an hour to an hour and a half, said Chief Prosecuting Attorney Randy Smith.
Smith continued, "By the victim's count, he choked her 20 to 30 times, He choked her into unconsciousness on, at least three occasions, probably more.
"This was a very violent attack," he said.
The victim was eventually able to get away and call law enforcement, Smith said.
Law enforcement did a good job of assessing the situation and connecting the victim to help and the defendant to jail, he said.
The detective who did the follow-up, Det. Paul Hardwicke, did an excellent job of interviewing the victim and documenting the case, allowing for a successful prosecution, said Smith.
