BLACKFOOT — Bingham County Commissioners will take testimony on Draft 13 of the Planning and Zoning Proposed Code Revisions at 6:30 p.m. tonight in Courtroom #1 at the Bingham County Courthouse.
One of the subjects of contention is babysitting, called family day care in state statutes of Idaho. In Draft 13, babysitting is defined as caring for up to three children on a sporadic or occasional basis. The definition concludes by stating, “Babysitting is not regulated by this Title.”
Changes in Idaho Statutes are to go into effect on Jan. 1, 2010. Title 39 deals with health and safety. Chapter 11 of title 39 deals with basic day care license.
Idaho Code § 39-1102 (8) states, “’Family daycare home’ means a home, place, or facility providing daycare for six (6) or fewer children.”
Idaho Statute 39-1103, licensing authority, paragraph one states, “. . .The provisions of this chapter shall not apply to: (5) [the] care for children of a family within the second degree of relationship.”
The proposed daycare regulations in P&Z Draft 13 (6.2.14) states the general standards for all child daycare and adult care uses pursuant to Idaho Code § 39-1109 & 39-1110.
Idaho Code § 39-1109 deals with fire safety standards. Sub-point (4) (f) states, “Family daycare homes shall not provide daycare services for more than six (6) children at a time.”
Idaho Code § 39-1110 deals with health standards. Family daycare is not mentioned in this statute.
Idaho Code § 39-1114 deals with LIMITED APPLICATIONS. [EFFECTIVE JANUARY 1, 2010] Sub-point (3) states, “A family daycare home providing care for fewer than seven (7) children may elect to comply with the provisions of this chapter and upon a finding of compliance by the department, shall receive a basic daycare license.”
Other areas of contention are the authority of the zoning administrator, from where the ordinances have come, and commercial wind turbines.
Two opponents of this draft are Julianne Young and Heather Goodworth from Blackfoot. These ladies have done extensive research comparing the Bingham County Planning Handbook that is in current use and the 13th Draft of the Proposed Code Revisions.
Young and Goodworth are currently working on a side-by-side comparison between these two documents. Results will be ready for tonight’s hearing, Goodworth said.
